TO THE MAXIMUM EXTENT PERMITTED BY LAW, VYUHAVARAHI, SUCHIR REDDY, AND OUR AFFILIATES DISCLAIM ALL LIABILITY FOR ANY UNAUTHORIZED ACCESS, HACKING, DATA LEAKS, OR LOSS OF DATA. WHILE WE IMPLEMENT REASONABLE SECURITY MEASURES, NO ELECTRONIC STORAGE OR TRANSMISSION IS 100% SECURE. YOU EXPLICITLY AGREE THAT YOU TRANSMIT AND STORE ALL DATA WITH US AT YOUR OWN ABSOLUTE RISK. WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, OR PUNITIVE DAMAGES ARISING FROM A CYBERATTACK OR DATA BREACH.

2. Client Responsibility for Third-Party Data (GDPR/CCPA)

If you are an agency client and you provide us with the Personally Identifiable Information (PII) of your customers, users, or employees for the purpose of software development, testing, or database migration, you legally warrant that you have obtained all necessary consents required by applicable data protection laws (including GDPR, CCPA, etc.).

Indemnification: You agree to unconditionally indemnify and hold harmless Vyuhavarahi and Suchir Reddy against any lawsuits, fines, or regulatory actions brought by your users or government bodies resulting from your failure to secure proper data consent or comply with privacy laws.

3. Third-Party Infrastructure & Subprocessors

Our services rely on third-party infrastructure providers (such as AWS, Vercel, Supabase, Google Cloud, etc.). We may share your data with these sub-processors exclusively to facilitate our services. You explicitly acknowledge and agree that Vyuhavarahi has no control over, and assumes zero legal or financial liability for, the privacy practices, data breaches, or security failures of any third-party infrastructure providers.

4. Law Enforcement & Mandatory Disclosures

We respect privacy, but we are not a sanctuary for illicit activity. As explicitly stated in our Terms of Service, if we detect or suspect that our services are being used for fraud, extortion, or any illegal acts, we reserve the absolute right to proactively disclose your identity, data, and communications to federal and local law enforcement agencies, financial crime units, or relevant authorities without requiring a court order or subpoena.
